This document describes the terms of use of the platform. By using the Platform, you signify that you have read, understood, and agree to be bound by these Terms of Use.
The service is provided as is and without any guarantees of availability at any time or location, uninterrupted or secure. Use of the Platform is at your own risk. The Platform is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Without limiting the foregoing, the University of Helsinki and its employees or directors do not warrant that any data is accurate, reliable or correct; that the platform will meet your requirements; that any defects or errors will be corrected; or that the platform is free of viruses or other harmful components. Any data uploaded or downloaded or otherwise obtained through the use of the Platform is uploaded or downloaded at your own risk and you will be solely responsible for any damage to your computer system or loss of data that results from such upload or download.
The party that uploads data into the Megasense Data Platform owns the data. The party that uploads data grants to the University of Helsinki, a worldwide, transferable, perpetual and sublicensable right to copy, modify, distribute, display, and process all of the data made available via the Data Platform, including but not limited to making the data available to other users within Platform, without any further consent, notice and/or compensation to the uploader or others.
The party that uploads data assures that the data does not contain any Personal Data, as it is defined in the General Data Protection Regulation (EU) 2016/679 (GDPR). The University of Helsinki shall not be in any way be liable or responsible if the uploaded data contains Personal Data.
As a registered user of the Megasense Data Platform, you are restricted from the following:
In no event shall University of Helsinki, nor any of its employees, directors or licensors, be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other losses, that result from the use of, or inability to use, the Megasense Data Platform or the data.
The University of Helsinki assumes no liability or responsibility for any (I) errors, mistakes, or inaccuracies of any data; (II) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Megasense Platform or the data; (III) any interruption or cessation of transmission to or from the Platform; (IV) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Platform by any third party; (VI) any errors or omissions in any data or for any loss or damage incurred as a result of the use of any data made available through the Platform; and/or (VII) any illegal conduct of any third party.
By using the Megasense Data Platform, you indemnify to the fullest extent University of Helsinki from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.
University of Helsinki reserves the right to amend these Terms at any time as it sees fit.
These Terms will be governed by and construed in accordance with the laws of Finland, without regard to the conflict of law provisions, and any disputes will be resolved in the Finnish judicial system.
